Terms of Sale

1. Seller identification

These Terms of Sale govern subscription purchases made between Fiducium Sàrl, a Swiss company headquartered in Neuchâtel (Switzerland), hereinafter "VisitCard", and any customer (individual or legal entity), hereinafter "the Customer".

2. Services and pricing

VisitCard offers the following subscription plans, billed in the currency automatically detected (CHF for Switzerland and Liechtenstein, EUR for other countries):

3. Order and contract formation

Orders are placed online via the /subscribe page. The sales contract is formed upon completion of the following steps:

  1. Selection of plan and billing period (monthly or annual)
  2. Acceptance of these Terms of Sale and consent to waiving the right of withdrawal
  3. Entry of payment information on the secure Stripe Checkout page
  4. Payment confirmation by Stripe — the Customer receives a confirmation email

4. Payment

Payment is processed exclusively by Stripe (Stripe Inc., 510 Townsend Street, San Francisco, CA 94103, USA), a PCI DSS certified payment service provider. VisitCard does not store any banking data. Accepted payment methods are those offered by Stripe (Visa, Mastercard, etc., subject to availability). For monthly subscriptions, the charge is automatically renewed each month on the anniversary date. For annual subscriptions, the charge is automatically renewed each year.

5. Service access — delivery

The service is a digital product delivered immediately upon payment confirmation. Access to the subscribed plan's features is activated instantly on the Customer's account. No physical medium is shipped.

6. Right of withdrawal (art. 16 of Directive 2011/83/EU)

Pursuant to article 16(d) of Directive 2011/83/EU on consumer rights, the 14-day right of withdrawal does not apply to contracts for the supply of digital content not supplied on a tangible medium where performance has begun with the prior express consent of the consumer and their acknowledgment that they will lose their right of withdrawal. During subscription, the Customer may tick the corresponding box to consent to immediate access to the service, thereby acknowledging that they lose the right of withdrawal from the start of service provision. If the Customer has not given this consent, they have a 14-day withdrawal period from the subscription date. To exercise this right, they must notify VisitCard at hello@visitcard.app before the deadline. Reimbursement will be made within 14 days of notification, via the same payment method.

7. Cancellation and refunds

The Customer may cancel their subscription at any time from their dashboard (Subscription section). Cancellation takes effect at the end of the current billing period; the Customer retains access to paid features until that date. No pro-rated refund is granted for the remaining period, except when exercising the right of withdrawal under the conditions of article 6 above, or in the event of a billing error attributable to VisitCard.

8. Price changes

VisitCard reserves the right to change its prices. Any price change will be notified to the Customer by email at least 30 days before it takes effect. If the Customer objects to the change, they may cancel their subscription before the effective date at no charge. Maintaining the subscription after that date constitutes acceptance of the new price.

9. Legal guarantee and customer service

VisitCard guarantees the conformity of the digital service in accordance with applicable legal requirements. In the event of a lack of conformity, the Customer may contact support at hello@visitcard.app. VisitCard undertakes to respond within a reasonable timeframe and to remedy any lack of conformity at no additional cost to the Customer.

10. Liability

VisitCard uses all reasonable means to ensure the availability and security of the service. Its liability may only be engaged in the event of proven fault, up to the amount paid by the Customer over the last 12 months. VisitCard shall not be liable for indirect damages (data loss, loss of revenue, etc.).

11. Applicable law and jurisdiction

These Terms of Sale are governed by Swiss law, excluding any conflict of laws rules. Any dispute relating to the interpretation or performance of these Terms shall be submitted to the competent courts of the canton of Neuchâtel (Switzerland), subject to the mandatory provisions protecting consumers residing in the European Union (in particular EU Regulation No. 1215/2012).
