1. Acceptance of terms
By using VisitCard, you agree to these terms of use. If you do not accept these terms, please do not use the service.
2. Service description
VisitCard is a SaaS platform for creating, sharing and analysing digital business cards. The service is accessible via web browser. The database and uploaded images are stored in the European Union (Cloudflare, EU jurisdiction); the service is delivered through Cloudflare’s global network.
3. Account creation
You must create an account to access the service. You are responsible for the confidentiality of your password and all activities carried out from your account.
3bis. Minimum age
The service is reserved for persons aged at least 18. By creating an account, you confirm that you are 18 or older. If we learn that an account has been opened by a person under 18, we may delete it.
4. Acceptable use
It is prohibited to use VisitCard to:
- Glorify terrorism, war crimes or crimes against humanity, or incite violence
- Incite hatred or discrimination against a person or a group of persons (art. 261bis of the Swiss Criminal Code)
- Impersonate the identity, name, logo, trademark or image of a natural or legal person, or create a risk of confusion with them
- Commit or facilitate fraud, in particular phishing, fake financial or crypto-asset offers, or the harvesting of login credentials
- Offer or promote illegal goods or services
- Publish pornographic or sexually explicit content
- Disclose third parties’ personal data without their consent, or harass, threaten or defame anyone
- Infringe intellectual property rights (copyright, trademarks)
- Endanger or exploit minors
- Send unsolicited messages (spam), engage in abusive search engine optimisation or create link farms
- Distribute malware or links to malware
- Attempt to bypass security measures
4bis. Responsibility for content
You alone are responsible for the content you publish on your cards (texts, photos, logos, links, documents), and you warrant that you hold all the rights and authorisations needed to publish it.
You shall hold Fiducium Sàrl harmless against any third-party claim and indemnify it for all costs and damages (including reasonable lawyers’ fees) resulting from your content or from a breach of these terms.
Where an organisation makes VisitCard available to its members (White-Label offer), that organisation is responsible toward Fiducium Sàrl for the content published by its members.
4ter. Reports and moderation
Anyone can report a card they consider unlawful or contrary to § 4, using the “Report this card” link shown on visitcard.app/c/… cards (/report page) or by email to hello@visitcard.app, stating the card’s address and the reasons for the report.
Reports are reviewed diligently by a person, without any general prior monitoring of content. The decision is communicated with its reasons to the user concerned and, if they provided an email address, to the person who made the report.
The user may contest a decision by sending a reasoned reply to hello@visitcard.app within 14 days of being notified.
5. Intellectual property
You retain ownership of your content (texts, photos, information). You grant VisitCard a limited licence to display this content as part of the service.
6. Free and paid plans
The Starter plan is free with no time limit. Pro and Team plans are subject to a monthly or annual subscription. Subscriptions may be cancelled at any time, free of charge.
7. Service availability
VisitCard strives to maintain maximum availability but does not guarantee uninterrupted access. Planned maintenance may be carried out with prior notice.
8. Limitation of liability
VisitCard shall not be liable for indirect damages resulting from the use or inability to use the service. Content published on cards is the sole responsibility of its authors (§ 4bis); Fiducium Sàrl does not review it before publication. Mandatory provisions of law are reserved.
9. Suspension and termination
Fiducium Sàrl may, without notice, make content inaccessible, or suspend or delete a card or an account, when it receives a sufficiently substantiated report or finds content that is manifestly unlawful or contrary to § 4, in particular where third parties are at risk.
It informs the user, stating the reasons, the content concerned and how to contest the decision (§ 4ter), unless the law prevents it or such information could hinder an investigation.
For other breaches of these terms, the user receives a prior warning before any suspension or deletion.
Fiducium Sàrl may retain the data needed as evidence and disclose it to the competent authorities.
10. Applicable law
These terms are governed by Swiss law. The place of jurisdiction is the company’s registered office, in Neuchâtel, Switzerland, subject to the mandatory provisions protecting consumers.

12. Right of withdrawal (EU / EEA residents)
If you reside in the European Union or the European Economic Area, you have a 14-day right of withdrawal from the moment you subscribe to a paid plan, without having to give a reason. When subscribing, you may expressly consent to immediate access to the service and acknowledge that you lose this right of withdrawal once the service begins. Without this express consent, you retain your 14-day right of withdrawal; contact hello@visitcard.app to exercise it. This right of withdrawal is reserved for consumers residing in the European Union or the European Economic Area (including Liechtenstein). Swiss law provides no right of withdrawal for contracts concluded online: customers domiciled in Switzerland do not have one.
